Partner Terms & FTC Disclosures
Last updated 2026-10-22 · Draft pending legal review
1. Relationship
This partner agreement is with Project DC Coast LLC, operator of Preflight. Partners are independent contractors. Nothing in these terms creates employment, agency or a joint venture. Partners may not speak on behalf of Preflight. California law governs this agreement, subject to applicable federal law.
2. FTC compliance (16 CFR Part 255)
Partners must comply with the FTC Guides Concerning the Use of Endorsements and Testimonials in Advertising, 16 CFR Part 255. Endorsements must reflect the partner's honest opinion and actual experience, and may not make claims PreFlight itself could not substantiate.
3. Mandatory disclosure
- Every post, email, video or conversation recommending PreFlight must clearly and conspicuously disclose the material connection, e.g. "I earn a commission if you purchase PreFlight through my link."
- Disclosures must appear before or next to the link, in plain language, and must not be hidden in hashtags, footers or "more" menus alone.
- Partners may not state or imply that PreFlight is a lender, predicts any lending decision or guarantees approval.
4. Anti-self-referral restriction
No commission is earned on purchases by the partner, the partner's business or employer, household members, or any entity the partner controls. Brand-term bidding, coupon sites, cookie stuffing and incentivized clicks are prohibited.
5. Payout conditions
- A flat $300 commission is earned per eligible paid workspace sale, at either the $1,995 list price or $995 founding price, within the 30-day attribution window.
- Each commission is held for 30 days after purchase; refunds, chargebacks or fraud during the hold void it.
- Refunds and chargebacks after payout are clawed back from future payouts.
- Payouts are issued monthly once the hold clears and valid tax information (e.g. IRS Form W-9) is on file.
6. No access to borrower data
Partners receive attribution and commission totals only. They never receive borrower documents, figures, analyses or contact details.
7. Termination
Either party may end the partnership at any time. Violations of these terms void pending commissions.
