Terms of Service
Last updated 2026-10-22 · Draft pending legal review
1. Agreement
These Terms govern use of Preflight ("the Service"), operated by Project DC Coast LLC. By creating an account or purchasing a workspace, the user agrees to these Terms and the Privacy Policy.
2. SaaS license
PreFlight grants a limited, non-exclusive, non-transferable, revocable license to use the Service for the user's own business preparation during the purchased term (a 90-day private workspace). The user may not resell, sublicense, reverse engineer or use the Service to provide lending, brokerage or underwriting services to third parties. The user retains ownership of all uploaded documents and figures; PreFlight retains ownership of the Service, its software and methodology.
3. Borrower-first utility boundary
- PreFlight is a preparation tool for small business owners. It is not a lender, broker, CPA, attorney or financial adviser.
- The Service does not make lending decisions, does not predict how any lender or credit committee will evaluate a file, and does not guarantee loan approval or terms.
- Results are deterministic scenario screening against general benchmarks. Automated extraction may contain errors; the user is responsible for verifying every figure.
- How the user uses an analysis, and whether to share it with anyone, is solely the user's decision.
4. Automated runs
Each workspace includes up to four automated document extraction runs. Manual entry and recalculation are unlimited. Purging a workspace does not restore used runs.
5. Retention and purge
Checkout is not active. Current pilot workspaces use a 30-day clock from first saved data; the remaining time appears in the workspace. Manual purge removes uploaded files, saved financials and extracted results immediately. Automated scheduled deletion is not yet activated; used extraction-run counts are preserved. Records currently download to the user's device and are not archived by the Service.
Paid-workspace policy, pending checkout and archive activation: the 90-day private workspace and raw-data retention window start only from verified purchase, never from first activity. Purge will remove raw documents, scenario working data and extraction results, while generated Records will remain available for 12 months from purchase. Expiry warnings are planned for seven days and 24 hours before purge. These paid-workspace protections are not yet operational in the pilot.
6. Fees, one-entity rule and fit guarantee
The list price is $1,995, one-time. The founding cohort offer is $995 for the first 25 paid workspaces, subject to checkout availability. Each purchased workspace is for one business; the first saved scenario will bind it to the business name and EIN. Changing the business requires support. Purchase enforcement is pending checkout activation.
A full refund may be requested within 14 days from purchase with no usage conditions. The guarantee is available once per customer, ever; eligibility is matched on account, email and payment-card fingerprint. Record-download timestamps and account identifiers will be logged for payment-dispute evidence when purchase logging is operational.
7. Acceptable use
The user may upload only documents the user is authorized to share and may not upload malicious files or attempt to access another user's data.
8. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, PreFlight is not liable for indirect, incidental, special, consequential or punitive damages, or for any lending decision, loss of financing, lost profits or lost data. PreFlight's total liability for any claim is limited to the amount the user paid for the Service in the 12 months before the claim.
10. Governing law and changes
These Terms are governed by California law, subject to applicable United States federal law. Project DC Coast LLC may update these Terms with notice; continued use means acceptance, except where applicable law requires otherwise.
